Dispute Resolution

Private claims or disputes between individuals, government departments and local authorities are often resolved through civil litigation proceedings.

If compensation through damages is sought then civil litigation often falls into two categories:

• one based on a contract being an agreement between two or more parties
• one based on a civil wrong caused by one party to another deliberately or negligently

There are a wide range of disputes based on contract; these may be as small as the purchase of a defective item, or multi million pound claims such as penalty clauses in an engineering contract.

Civil wrongs can include personal injury cases and/or damages to property and reputation.

If you are involved in a dispute with another individual or company we can advise you on your chances of success and the possible value of your claim. We can also advise you of possible alternative methods of dispute resolution (ADR) such as mediation or conciliation

At Blackhurst Budd we are more than happy to negotiate on your behalf. If needs be we will commence or defend proceedings in the county or high court according to the severity of the case.

In suitable cases we may consider offering clients a no-win-no-fee case, however these will be subject to a number of circumstances.

Due to the high risk of loss in civil litigation proceedings, it is our practice to advise clients to reach an agreement as opposed to undergoing potentially costly proceedings.
